Rhode Island Custody and Visitation Issues

When One Parent Lives Out of State

In some instances, a divorce occurs where one parent either moves out of state for job reasons, or lives out of state already. Situations where a spouse was pregnant before a divorce and did not tell the father, or where one parent had a job offer out of state before the divorce was finalized can and do occur.

The Court will still base the custody decision upon the same factors, except that the non-custodial parent will have to arrange visitation for themselves and with their ex-spouse. In many of these cases, the parties were never married, and the parents of the child simply parted company.

The absent parent will still be responsible for child support, whether there is standard visitation or not. And the out of state parent will be responsible for any financial expenses relative to visitation, as well as working out a suitable schedule for both the custodial parent and the child, should they decide to exercise their visitation rights with their child.

Unwanted Divorce in Rhode Island

When One of You Wants to Stay Married

A divorce between married couples is often not a mutual decision. One party or the other may decide they want to divorce for any variety of reasons. If you are served with a Rhode Island divorce complaint, do not hesitate to contact a good RI divorce attorney to help you answer the complaint.

Waiting is a mistake that some parties make and then find that the time to answer the complaint has elapsed and they can no longer contest the action.

If you hire a lawyer immediately, you can contest the divorce and secure your rights as a party to the action. A RI family court lawyer will be able to file the necessary documents to answer your complaint and prevent your divorce from moving forward without your objections being heard. In some cases, the time it takes to reach trial or mediation may be all that is needed to work out whatever differences the couple may be having.
